Reckless or criminal activity

If at the time of the accident, a person was;

• engaged in conduct which created a risk and recklessly ignored that risk;
• found guilty of manslaughter, dangerous driving, or an offence that was intentional, reckless, or criminally negligent that caused harm.

The injured person will not be entitled to benefits for:

• Loss of earning capacity 
• Lump sum compensation for permanent impairment

If the injured person dies as a result of the accident, their family will not be entitled to:

• Lump sum death benefits
• Child dependency benefits
